Welcome to Emoji Translator. By installing, accessing, or using our Chrome extension ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service.

1. Acceptance of Terms

By using Emoji Translator, you affirm that you are at least 13 years of age and capable of entering into a binding agreement. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

2. Description of Service

Emoji Translator is a Chrome extension that uses artificial intelligence to translate selected text into emoji representations. The Service offers both free and paid subscription tiers:

2.1 Free Plan

• 1,000 emoji translations per day
• 20 English gloss lookups per day
• Access to daily language packs
• Ability to save up to 200 favorite translations
• All core features

2.2 Pro Plan

• Unlimited emoji translations per day
• Unlimited English gloss lookups per day
• All features from the Free plan
• Priority support
• Early access to new features

3. User Obligations

You agree to:

• Use the Service only for lawful purposes and in accordance with these Terms
• Not attempt to circumvent, disable, or interfere with the Service's rate limits or security features
• Not use the Service to process, store, or transmit any content that is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable
• Not reverse engineer, decompile, disassemble, or attempt to derive the source code of the AI models or proprietary algorithms
• Not use automated scripts, bots, or other means to abuse or overload the Service
• Not resell, redistribute, or sublicense access to the Service without explicit written permission

4. Subscription and Payment Terms

4.1 Pro Subscription

The Pro Plan is offered as a recurring monthly subscription. By subscribing, you authorize us to charge your payment method on a recurring basis until you cancel.

4.2 Payment Processing

All payments are processed securely through Paddle.com Market Limited ("Paddle"), our authorized payment processor. By subscribing, you agree to Paddle's terms of service and privacy policy. We do not store or have access to your payment card details.

4.3 Billing

• Subscriptions are billed in advance on a monthly basis
• Your subscription will automatically renew each month unless canceled
• Price changes will be communicated at least 30 days in advance
• All fees are non-refundable except as required by law or as stated in our Refund Policy

4.4 Cancellation

You may cancel your Pro subscription at any time through your account settings or by contacting support. Upon cancellation:

• You will retain Pro access until the end of your current billing period
• You will not be charged for subsequent billing periods
• Your account will revert to the Free plan at the end of the billing period
• No partial refunds will be issued for unused time in the current billing period

5. Usage Limits and Fair Use

The Service is designed for individual, personal use. We reserve the right to:

• Enforce daily usage limits for Free plan users
• Investigate and take action against accounts showing signs of abuse, automated access, or commercial resale
• Implement reasonable rate limits even for Pro users to ensure service quality for all users
• Suspend or terminate accounts that violate fair use principles

6. Intellectual Property

6.1 Our Rights

The Service, including all AI models, algorithms, software, design, text, graphics, logos, and other content (excluding user content), is owned by us or our licensors and is protected by copyright, trademark, and other intellectual property laws.

6.2 Your Content

You retain all rights to the text you input into the Service. The emoji translations generated by the Service are considered output created by our AI models and may be used by you for any lawful purpose.

6.3 Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service in accordance with these Terms. This license terminates automatically if you violate these Terms.

7. Privacy and Data

Your privacy is important to us. Our Privacy Policy explains how we collect, use, and protect your information. By using the Service, you agree to the collection and use of information in accordance with our Privacy Policy.

8. Service Availability

We strive to provide reliable service, but we do not guarantee that:

• The Service will be available at all times without interruption
• The Service will be error-free or completely secure
• The results will be accurate, complete, or appropriate for your purposes
• Any defects will be corrected

We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time with or without notice.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not warrant that:

• The emoji translations will be accurate, appropriate, or suitable for any particular purpose
• The AI models will correctly interpret context or meaning in all cases
• The Service will meet your specific requirements

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• YOUR USE OR INABILITY TO USE THE SERVICE
• ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SERVERS
• ANY INTERRUPTION OR CESSATION OF THE SERVICE
• ANY BUGS, VIRUSES, OR OTHER HARMFUL CODE TRANSMITTED TO OR THROUGH THE SERVICE
• ANY ERRORS OR OMISSIONS IN CONTENT OR TRANSLATION RESULTS

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.

11. Indemnification

You agree to indemnify, defend, and hold harmless Emoji Translator and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with:

• Your access to or use of the Service
• Your violation of these Terms
• Your violation of any third-party rights, including intellectual property, privacy, or publicity rights

12. Modifications to Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by:

• Posting a notice in the extension
• Updating the "Last Updated" date at the top of these Terms
• Sending an email to registered Pro users (if applicable)

Your continued use of the Service after such modifications constitutes acceptance of the updated Terms.

13. Termination

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including:

• Violation of these Terms
• Fraudulent, abusive, or illegal activity
• At our sole discretion

Upon termination, your right to use the Service will immediately cease. All provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, and limitations of liability.

14. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which we operate, without regard to its conflict of law provisions.

Any disputes arising from these Terms or the Service shall be resolved through:

• Good faith negotiations between the parties
• If unresolved, binding arbitration in accordance with the rules of the American Arbitration Association (or equivalent in your jurisdiction)
• You agree to waive your right to participate in class actions or class arbitrations

16. Severability
